3.2 Kautionen / Sicherheiten
The amount of the tender security is 14,000 euros, which may be submitted in the form of a guarantee (original letter) of a bank or any other credit institution or deposited on the bank account No. 10702000639002, SEB Bank, of Väätsa Rural Municipality Government
The contractor shall submit a security for the period of construction in the amount of ten per cent (10%) of the contract price, exclusive value added tax. The security will be deposited on the bank account No. 10702000639002, SEB Bank, of Väätsa Rural Municipality Government (within 7 days from entering into the contract).
The contractor shall provide the Contracting Authority with a maintenance bond in the amount of two per cent (2%) of the contract price, exclusive value added tax. This shall be given in the form of a guarantee certificate issued by a bank or an insurance or financial institution (on the date of the final instrument of delivery and receipt).
The contractor shall, at their own expense, acquire a constructor's all risk insurance (CAR) to the construction that is the object of the public contract.

aufgrund der nachstehenden Kriterien:
Individual standing of tenderers or candidates, including requirements to be registered in profession or business registers (grounds for exclusions from procurement procedure)
Details required for evaluation of the compliance with award criteria and their formal requirements:
1. As regards the tenderer, there must be no grounds for exclusion specified in subsections 38 (1) and (2) of the Public Procurement Act. The tenderer submits a written confirmation on the absence of grounds for exclusion, using Form 1. Form of the document to be attached: Form 1
2. The tenderer must have met all payment obligations in the meaning of clause 38 (1) 4) of the Public Procurement Act, i.e. paid all statutory state taxes and social insurance contributions.
In order to prove that, the tenderer registered outside the Republic of Estonia must provide relevant certificates as of the date of the publication of the Contract Notice. As regards the tenderers registered in the Republic of Estonia, the performance of tax obligations will be verified on the basis of public databases by the Contracting Authority.
3. The tenderer must have met all payment obligations in the meaning of clause 38 (1) 4) of the Public Procurement Act, i.e. paid all local taxes of their place of residence or seat.
In order to prove the absence of arrears of local taxes, the tenderer registered in the Republic of Estonia shall provide a relevant certificate issued by local authorities.
4. If the tender is signed by a person whose right of representation is not provided by law (the right of representation is not entered on the tenderer's registry card of part B of the Commercial Register) or is submitted by a joint tenderer, the tenderer shall provide a letter of authorisation with which the person signing the tender is granted necessary powers. In the event of a joint tender, the main joint tenderer must be indicated in the letter of authorisation.
The tenderer shall submit the letter of authorisation using Form 2a.
Note: Form 2a shall be submitted only in the cases when the tender is not signed by the person entitled to do that by law and indicated on the registry card of part B of the Commercial Register. Form of the document to be attached: Form 2a
5. Joint tenderers shall appoint a representative authorised to take steps relating to the procurement procedure and to awarding, entering into and carrying out the framework agreement.
The letter of authorisation given to their representative by joint tenderers shall be submitted as Form 2b.

III.2.2) Financial and technical standing
Details required for evaluation of the compliance with award criteria and their formal requirements: 1. The tenderer's average net turnover for the last three financial years (2010 - 2012) must be at least 4,000,000 (four million) euros.
Required document: The tenderer submits Form 3 with the extracts of their net turnover for the last three financial years (separately for each year). If the tenderer has been operating for less than three years (i.e. has started business activity later), the average net turnover shall be calculated as the average for the time in operation. Form of the document to be attached: Form 3
2. The tenderer must have financial resources that are sufficient to guarantee the performance of construction work according to the public contract, or a possibility to acquire the necessary financial resources.
Documents to be submitted: A guarantee letter issued by the tenderer's bank confirming the possibility to get credit in the amount of up to 350,000 euros for the performance of the public contract, or confirming the existence of remaining credit amount or financial resources.
III.2.3)Technical and professional ability
Details required for evaluation of the compliance with award criteria and their formal requirements:
1. The tenderer must provide a written confirmation on registrations in the special registers of the country of their location (Register of Economic Activities) for the construction activity (general construction activity, inner-building and inner-premise heating systems and boiler rooms, ventilation systems, inner-building and inner-premise water supply and sewer systems, weak-current systems), the number and term of a registration and relevant information on licences (may be presented also in the form of printouts from online databases).
2. Using Form 4, the tenderer shall submit a list of similar constructions performed within the last five years (September 2008 - August 2013) (as similar, the objects under the following codes are deemed: codes 11300 to 11322 (both indicated codes included); 12110 to 12129; 12600 to 12639; 12650 to 12659; (indicated codes included)), and shall specify in the list the value of the works performed, the time of completion of the construction or putting it into service, the energy class of the constructed building (if not identifiable from the Construction Registry, a copy of energy performance certificate according to the building design), the code of the purpose of use and public works awarded (PPA clause 41 (1) 1)).
a. Minimum requirement: i. At least 5 similar objects must be constructed/renovated. ii. In addition, the tenderer/joint tenderer must, within the last five (5) years (September 2008 - August 2013), have constructed/renovated at least one low-energy public building in the meaning of the Government of the Estonian Republic Regulation No. 68 of 30 August 2012 "Minimum Requirements for Energy Performance" (the Contracting Authority means here a building falling into energy classes A or B), which must have been in operation for at least one year. To be indicated separately in the form. Form of document to be attached: Form 4 3. The tenderer's confirmation (in free form) on the existence of work equipment and vehicles, plant and technical equipment, or the existence of the relevant written statement for the acquisition or taking into use of necessary equipment that can be used by the tenderer or applicant in performing the public contract (PPA clause 41 (1) 8)). 4. The project manager must: - have a degree in construction from a higher education institution;
- have a 5-year experience of working as a project manager;
- have within the last three (3) years (September 2010 - August 2013) been working as a project manager in at least two (2) similar construction/renovation projects (as similar, the objects under the following codes are deemed: 11300 to 11322 (both indicated codes included); 12110 to 12129; 12600 to 12639; 12650 to 12659 (indicated codes included)) (submit a list of similar projects with details on the value, performance and commissioner of the work in which the person under question has been involved in, marking in different colour the projects in which the person has operated as a project manager);
- have experience in construction of an energy-efficient building (indicate the name, purpose of use and energy class of the object);
- be proficient in the Estonian language (may also use translation/interpretation services).
5. The object manager must:
- have at least vocational secondary education in construction or a corresponding professional qualification (at least level III);
- have worked as an object manager or site manager for at least 3 years;
- have participated in the performance of at least one similar construction work (of a given quantitative scope).
6. The tenderer (or the main tenderer in the event of a joint tender) must have developed and introduced, for carrying out construction works, the following quality management, environmental management and occupational safety systems:
a) Quality management system according to ISO 9001:2008 or equal. Submit a copy of a certificate or the management system handbook;
b) Environmental management system according to ISO 14001:2004 or equal. Submit a copy of a certificate or the management system handbook;
c) Occupational health and safety system according to OHSAS 18001:2007 or equal. Submit a copy or management system handbook.
