The object of the order includes the carrying out the modernisation of the railroad track No. 1 of the railway line No. 47 of the railway service Komorów - Podkowa Lesna Glówna and the railway track No. 1M of the railway line No. 48 of the railway service Podkowa Lesna Glówna - Milanówek Grudów within the framework of the Project entitled: "Development of the public transport in Warsaw metropolitan area through improvement of the WKD (Warsaw Commuter Railway) efficiency, reliability and safety" supported by a grant from Switzerland through the Swiss Contribution to the enlarged European Union. The Project includes the improvement of regional rail services thanks to providing high quality of railway infrastructure for all the WKD lines in the Warsaw agglomeration.

Place of construction works through the modernisation: the railway line managed by the Contracting Authority: No. 47 from Komorów to Podkowa Lesna and No. 48 from Podkowa Lesna to Milanówek.

3. Bedingungen
3.2 Kautionen / Sicherheiten
Deposits / guaranteesThe Contracting Authority requires the Contractors to secure the key money.
1. The Contracting Authority requires the Contractors to secure the key money in the amount of:
PLN 100,000.00 (say: one hundred thousand zlotys).
2. The payment of key money shall be effectuated prior to the expiry of the time limit for submission of tenders. The date of payment of the key money shall be the date of crediting the bank account of the Contracting Authority.
3. The key money shall be valid for the whole tender validity period, i.e., 30 days.
4. The key money may be deposited in one or several of the following forms:
a) cash;
b) bank sureties or guarantees of collective savings-loan fund, however the surety of a collective savings-loan fund is always a financial surety;
c) bank guarantees;
d) insurance guarantees;
e) Sureties given by entities referred to in Article 6b Paragraph 5 Point (2) of the Act of 9 November 2000 on Establishment of Polish Agency for Enterprise Development (Journal of Laws of 2007, No. 42, item 275, of 2008 No. 116, item 730 and 732 and No. 227, item 1505 and of 2010 No. 96, item 620).
5. The payment of key money in cash shall be paid by a bank transfer to credit the Contracting Authority's bank account: Pekao Bank S.A. branch Grodzisk Mazowiecki, bank account number 68 1240 5918 1111 0000 4910 0198 with a note: "Key money in the procedure No. WKD10c-229-20/2016".
6. The Contracting Authority will hold the key money paid in cash in the bank account.
7. A non-cash deposit should be submitted in the original version attached to the tender in an envelope described as "KEY MONEY" but put into the envelope containing the tender.
8. The guarantee (collateral security) should clearly indicate the way of representing the Guarantor. The guarantee has to be signed by an authorised (empowered) representative of the Guarantor. The signature should be put in a way enabling his identification, e.g. put together with a name stamp or legible (with name and surname).
9. The guarantee should contain an unconditional obligation of the Guarantor to pay the Contracting Authority the full amount of the key money at the first written request from the Contracting Authority under the circumstances set out in Article 46, Paragraph 4a and 5 of the Public Procurement Law without any objections from the Guarantor.
10. The failure to submit the key money in the required amount and form by the fixed time limit will cause a Contractor to be excluded from the contract award procedure.
11. The Contracting Authority will return key money to all Contractors immediately after the selection of the most advantageous tender or after the cancellation of the procedure, apart from the Contractor whose tender was selected as the most advantageous, subject to point 15.
12. The Contracting Authority will return the key money to the Contractor whose tender was selected as the most advantageous immediately after the conclusion of the public procurement contract.
13. The Contracting Authority will return the key money immediately after the request of the Contractor who withdrew the tender before the deadline of the submission of the tenders.
14. The Contracting Authority requires the Contractor who received the key money in accordance with Article 46, Paragraph 1 of the Public Procurement Law to pay the key money again if the disposal of the appeal resulted in the selection of the tender as the most advantageous. The Contractor will pay the key money within the period specified by the Contracting Authority.
15. The Contracting Authority will keep the key money with interests if the Contractor upon request referred to in Article 26, Paragraph 3 of the Public Procurement Law due to reasons attributable to the Contractor does not submit documents or declarations referred to in Article 25, Paragraph 1 of the Public Procurement Law, authorisations, list of entities affiliated with the same capital group or information that he is not affiliated with a capital group or he does not consent to correct the error referred to in Article 87, Paragraph 2, point 3 which results in the inability to select the tender submitted by the Contractor as the most advantageous.
16. The Contracting Authority keeps the key money with interests if the Contractor whose tender is selected:
a) refuses to sign the public procurement contract under the terms set out in the tender;
b) does not provide the required security for a satisfactory performance of the contract;
c) the conclusion of the public procurement contract is not possible due to reasons attributable to the Contractor.

3.5 Bietergemeinschaft
Permitted.
The Contractors who submit a joint tender shall appoint a representative to represent them during the contract award procedure or during the public procurement procedure and its conclusion. The authorisation to fulfil this function should be issued in accordance with the requirements of the law, signed by legally authorised representatives of each partner and attached to the tender.

3.7 Eignungskriterien
aufgrund der nachstehenden Kriterien:
Compulsory criteria for qualification for participating in the tender Conditions for participation in the procurement procedure and the description of the procedure for the assessment of the fulfilment of the conditions:
The condition for the participation in the procedure includes the Contractor proving that the Contractor:
1) has license for carrying out given actions or activity if provisions provide for the obligation to have it;
The Contracting Authority does not specify the requirements for fulfilment of the above condition.
2) has knowledge and experience;
To prove that the Contractor fulfils the condition of knowledge and experience the Contractor will show that in the last five years before the deadline for the submission of tenders, and if the period of operation is shorter - in this period, the Contractor carried out at least one work in the field of construction or reconstruction or renovation or modernisation of railroad tracks in the amount not less than 2 million zlotys gross each and the Contractor will attach evidence indicating that the work was carried out in an appropriate way and indicating that it was carried out according to the rules of the trade and properly completed.
3) has technical capacity and personnel capable of performing the contract;
To prove that the Contractor fulfils the conditions of having personnel capable of performing the contract the Contractor has to demonstrate that the Contractor has a person licensed to fulfil independent technical functions in the building industry to the extent of managing construction works in the discipline of railways (in a limited scope or without any restriction) issued pursuant to the Act of 7 July 1994 on construction law (consolidated text: Journal of Laws of 2016, item 290) and implementing provisions of this Act or corresponding building licences, which were issued pursuant to previously existing provisions of law.
4) economic and financial standing;
The Contracting Authority does not specify the requirements for fulfilment of the above condition.
The evaluation of compliance with specific objectives shall commence on the grounds of the documents mentioned in section 10 of the SETC in accordance with the formula: "meets conditions/does not meet conditions". The content of submitted documents or statements must show clearly that the Contractor complies with the conditions.
The Contractors who are affiliated with the same capital group in accordance with the Act of 16 February 2007 on Competition and Consumer Protection (consolidated text: Journal of Laws of 2015, item 184) and submitted individual bids in the procedure will prove that their relation do not infringe fair competition among the Contractors in this procedure.
3.8 Geforderte Nachweise

List of declarations and documents to be submitted by the Contractors in order to confirm the fulfilment of the conditions for the participation in the procedure:
The complete tender consists of the following documents and appendices:
1) completed and signed tender form in compliance with the template form of the Appendix No. 1 to SETC;
2) authorisation for the persons who submit the tender on behalf of the Contractor if the authorisation of those persons is not provided by other documents submitted with the tender;
3) list of entities affiliated with the same capital group or an information about non-affiliation with a capital group in compliance with the template form of the Appendix No. 7 to SETC
Declarations or documents confirming the fulfilment of the conditions for the participation in the procedure:
4) declaration of the Contractor on the fulfilment of the requirements to participate in the procedure in compliance with the template form of the Appendix No. 2 to the SETC;
5) list of construction works carried out during the last five years before the deadline for the submission of tenders and if the period of operation is shorter - during this period - with their type and amount, date and place of completion as well as attached evidence indicating that the works were carried out in an appropriate way and indicating that they were carried out according to the rules of the trade and properly completed - in accordance with the condition defined in section 9, point 2) of the SETC, according to the template form of the Appendix No. 5 to the SETC;
6) list of people who will participate in the performance of the contract, especially the persons responsible for the management of the construction works with information on their professional qualifications, experience and education necessary to perform the contract as well as the scope of activities carried out by them and information on the basis of using those persons - in accordance with the condition defined in section 9, point 3) of the SETC, according to the Appendix No. 6 to the SETC.
Documents confirming the lack of grounds for exclusion from the procurement procedure:
7) statement of the Contractor on the lack of grounds for exclusion from the procedure in compliance with the template form of the Appendix No. 3 to the SETC;
8) valid transcript from the appropriate commercial register or from the central company registry and information about the business entity if other regulations require registration or records in order to demonstrate the lack of grounds for exclusion issued not earlier than 6 months before the deadline for submission of tenders.
Contractors whose registered seat or place of residence is outside the territory of the Republic of Poland:
1) If the Contractor's registered seat or place of residence is outside the territory of the Republic of Poland, instead of the documents referred to in section 10.1, point 8) of the SETC, the Contractor submits a document or documents issued in the country of the registered office or the place of residence, confirming that it is not under liquidation or declared bankruptcy published not earlier than 6 months before the deadline for submitting tenders.
2) If there are doubts regarding the content of a document submitted by the Contractor, whose registered seat or place of residence is outside the territory of the Republic of Poland, the Contracting Authority may apply to competent authorities of the Contractor's country of residence or country where their registered seat or place of residence is located to obtain necessary information regarding the submitted document.
3) The original documents or certified true copies should be submitted by the Contractor. The original or copy of the authorisation certified by a notary public referred to in section 10.1, point 2 should be submitted.
4) In the case of Contractors participating jointly in the contract award procedure and in the case of other entities whose resources the Contractor relies on in accordance with the principles provided for in Article 26, Paragraph 2b of the Public Procurement Law, copies of the documents regarding the Contractor or those entities may be certified by the Contractor or those entities respectively.
5) The Contracting Authority may request to present the original or a copy certified by a notary public only when the submitted copy of the document is illegible or there are doubts as to its authenticity.
6) The documents issued in a foreign language should be submitted together with translation into Polish.
3.9 Zuschlagskriterien
aufgrund der nachfolgenden Angaben:
 In order to select the most advantageous tender, the Contracting Authority has developed the following tender evaluation criteria of the respectively assigned score in weight percentage terms:
The lowest gross quotation price - 90%
Guarantee - 10%
1) Rules of the evaluation of tenders in accordance with the set out criteria:
a) the lowest gross quotation price will obtain the maximum score in terms of the number of points - 90.00. The following mathematical formula will be applied to calculate the gross quotation-based price criterion
Quotation Price = [Lowest gross quotation price / Gross quotation price of the evaluated tender] x 90 points
b) in the case of the guarantee-based criterion - the tender with the longest duration of the guarantee will obtain the maximum score in terms of the number of points - 10.00. The following mathematical formula will be applied to calculate the guarantee-based criterion:
Guarantee = [Duration of the guarantee offered in the evaluated tender / The longest offered duration of the guarantee] x 10 points
The minimum duration of the guarantee is 24 months, the maximum duration of the guarantee is 36 months. The Contracting Authority stipulates that the guarantee will be evaluated in accordance with the provisions of point b), however, in case when the offered guarantee will be longer than 36 months the Contracting Authority will evaluate the tender as a tender with the duration of the guarantee of 36 months.
The total number of points a tender will be granted will be calculated according to the formula:
The evaluated tender = the sum of points for the quotation PRICE-based criterion + the sum of points for the GUARANTEE-based criterion
2) The most advantageous tender may obtain the maximum score of 100 points.
3) The Contracting Authority will deem the tender with the highest total score for the quotation price-based criterion and the guarantee-based criterion to be the most advantageous.
4) If it is not possible to choose the most advantageous tender in the course of the contract award procedure because two or more tenders have the same total score for the quotation price-based criterion and other tender evaluation criteria, the Contracting Authority shall choose the tender including a lower price.

1. Contractors may appear in person and collect a printed version of the Specification of Essential Terms of Contract at the Contracting Authority's registered office (room No. 9 at 2nd floor) between 9:00 AM-2:00 PM. The fee for the SETC in printed version amounts to PLN 20.00. Upon the request of the Contractor for the SETC to be sent by post, the amount of PLN 20.00 and PLN 15.00 on account of postal charge should be transferred to the Pekao SA Bank account number 68 1240 5918 1111 0000 4910 0198 and a proof for the bank transfer should be attached to the request for the SETC. The SETC will be delivered to the Contractor within five days following the receipt of a written request.
2. The procedure shall be conducted in the Polish language. The tender documents are in Polish language.

Information on meeting of the Contractors:
1. The tender may be submitted by a natural person, legal person or organisational unit which is not incorporated and by those entities acting jointly.
2. A Contractor may submit only one tender.
3. The Regulations regarding sectoral procedures in the Warsaw Commuter Railway Limited Liability Company exempt from the Public Procurement Law apply to the matters not regulated by the SETC. Other matters not covered by the Regulations are regulated by the provisions of the Act of 29 January 2004 on Public Procurement Law (consolidated text: Journal of Laws of 2015, item 2164).
