The objective of the project is the reconstruction of the domestic hot water system based on a solar system fed from a set of solar collectors, the completion of a central heating system, the completion of a boiler room equipped with a gas-fired boiler at Henryk Sienkiewicz School Complex No. 1 in Kolobrzeg at ul. 1-Maja 47, Plot No. 231/7, Area 11. A detailed description of the object of the contract is contained in Attachment no. 1 to the Specifications (Terms of Reference).

3. Bedingungen
3.2 Kautionen / Sicherheiten
The amount of security deposit is PLN 50 000.00. The security deposit may be provided at the discretion of the Contractor in one or more of the following forms:
cash;
bank or credit union surety provided that the obligation must always be a financial obligation;
bank guarantees;
insurance guarantees, sureties given by the entities referred to in Article 6 b paragraph 5 item 2 of the Polish Agency for Enterprise Development Establishing Act of 9 November 2000 (Journal of Laws Dz.U. No, 42 of 2007, item 275;No. 116 of 2008, items 730 and 732 and No. 227, item 1505, No. 96 of 2010, item. 620);
The security deposit shall be provided before the deadline for tender submission and if the deposit is provided in cash, the bank account of the Contracting Authority must be credited before the deadline.
The security deposit provided in cash shall be paid by the Contractor by bank transfer into:

The title of the bank transfer should read:

The Contracting Authority shall deem the security deposit paid by the set deadline if the deposit amount is recorded in the Authority's bank account by the date and time for tender submission.
If the security deposit is provided in cash, the Contracting Authority shall refund the deposit amount with interest resulting from the bank account contract applicable to the account in which the sum has been deposited, reduced by the costs of operation of the account and the bank commission for the transfer of funds to the account indicated by the Contractor.
The security deposit provided in another form than cash, as defined in Article 45 paragraph 6 items 2-5 of the Act shall contain the commitment of the guarantor or surety to pay unconditionally at each request of the Contracting Authority the full amount of the security deposit in the circumstances defined in Article 46 paragraph 4a and paragraph 5 of the Act.
Sureties and guarantees shall cover the period for which the Contractor is bound by its tender which commences with the expiry of the deadline for tender submission.
The Contracting Authority shall refund the amounts of security deposits upon the selection of the most advantageous tender or cancellation of the procedure to all Contractors, except for the Contractor whose tender is selected as the most advantageous one.
The Contractor whose tender is selected as the most advantageous one shall be reimbursed for the security deposit amount by the Contracting Authority immediately upon the execution of the Contract and provision of a performance bond.
At the request of the Contractor whose tender is selected as the most advantageous one, the Contracting Authority shall account the deposit paid in cash against the performance bond.
The Contracting Authority shall immediately refund the security deposit at the request of the Contractor that decides to withdraw its tender before the deadline for tender submission.
The Contracting Authority shall request the Contractor that received the refund of the security deposit amount in accordance with the foregoing provision if upon final consideration of an appeal the tender of this Contractor is selected as the most advantageous one. The Contractor shall provide the security deposit by the date set by the Contracting Authority.
The Contracting Authority shall retain the security deposit with interest if the Contractor in response to the request referred to in Article 26 paragraph 3 fails to submit documents or statements referred to in Article 25 paragraph 1, or powers of attorney, unless the Contractor proves that this results from reasons beyond the Contractor's control.
The Contracting Authority shall retain the security deposit with interest if the Contractor whose tender is selected:
1)refuses to execute the Contract on the conditions defined in the tender;
2)fails to provide the performance bond;
3)the execution of the Contract becomes impracticable due to reasons controlled by the Contractor.

3.4 Einzubeziehende Kosten
The price shall be quoted in PLN.
The offered price shall be a gross fixed price (expressed in figures and in words) for the performance of the Contract, including the amount of tax on goods and services at the rate applicable on the date of tender submission.
The total gross amount from the Price Form should be copied to the Tender Form.
The offered price shall be a fixed and final remuneration payable to the Contractor for the performance of the Contract, regardless of the amount of work and other considerations and expensed incurred by the Contractor on the works which should be included in the offered price.
The offered price should be calculated by the Contractor on the basis of the Contractor's own estimates and economic profitability. The offered price shall include all works and tasks necessary to correctly complete the object of the Contract.
The Contractors are encouraged to make a visual inspection of the site to familiarize themselves with the object of the Contract and include in the offered price all costs of works necessary to complete the works properly, in accordance with the work technology defined in the Technical Specifications for Work Completion and Acceptance, design documents and with take-offs as ancillary documents.
The gross price should include discounts offered by the Contractor, if any.

3.7 Eignungskriterien
aufgrund der nachstehenden Kriterien:
The Contractor must demonstrate that within the period of the last five years before the deadline for tender submission, or within a shorter period if the Contractor was established within the last five years, the Contractor has completed at least two construction, installation and assembly projects consisting in the construction, reconstruction or repair of a solar system fed by a set of solar collectors of a total value amounting to at least PLN 1.000.000,00 each.
The Contractors must also demonstrate that they employ or hire:
- at least one person who will be appointed as a plumbing works manager, and possesses a contractor licence authorising him or her to supervise installation works in the field of heating networks, installation of heating devices, ventilation and gas-fed devices, water supply and sewerage systems, and at least 5-year experience in this field, who supervised construction works during at least two projects, or supervised implementation of at least two contracts, that included the construction, reconstruction or repair of natural gas, water supply, sewerage, heating, ventilation systems or networks or the installation of a solar system (solar collectors), each with a value of at least PLN 200 000 gross (including VAT),
- at least one person who will be appointed as an electrical works manager, and possesses a contractor licence authorising him or her to supervise installation works in the field of electrical wiring and electric power systems, installation of electrical and electric power devices, and at least 5-year experience in this field, who supervised construction works during at least two projects, or implementation of at least two contracts, that included the construction, reconstruction or repair of electrical wiring and electric power systems or the installation of a solar system (solar collectors), each with a value of at least PLN 200 000 gross (including VAT),
- at least one person who will be appointed as an installation works manager during the installation of solar systems (including management of an installer team who will assembly and install solar systems), holder of a technical university or technical secondary school diploma, and of a contractor licence authorising him or her to supervise installation works in the field of water supply and sewerage systems, heating, ventilation systems or electrical wiring and electric power systems, with at least 2-year experience in supervising construction works during installation of solar systems (solar collectors),
- at least four persons who will be employed as solar collector installers, including at least two persons to be appointed as Team Leaders who possess a certificate of completed training course in the installation of solar systems or hold a certificate of accredited installer issued by a solar collector manufacturer.
The Contractors are also required to demonstrate that they have purchased an insurance policy covering their business activities related to the object of the Contract for an amount at least PLN 1 000 000.00 and demonstrate that they possess funds or creditworthiness to an amount of at least PLN 1 000 000.00.
3.8 Geforderte Nachweise
aufgrund der nachstehenden Nachweise:
The fulfilment of the conditions for the participation in the procedure as described in detail in the Terms of Reference shall determined on the basis of ?statements made by the Contractors concerning their fulfilment of the conditions for the participation in the procedure (according to the forms enclosed as Attachments 4 and 5 to the Terms of Reference), and of an analysis of submitted statements and documents listed below:
1.1. a statement concerning the fulfilment of conditions for the participation in the procedure referred to in Article 22 paragraph 1 of the Act;
1.2. A list of major construction works completed within the last five years preceding the deadline for tender submission, and if the Contractor has been established within the period of the last five years, within a shorter period of operation, including the type and value of the works, dates and locations of their completion with attached evidence for the major works documenting if they have been carried out according to the orders, the principles of the construction trade and correctly completed;
1.3. a list of persons who will participate in the performance of the Contract, responsible for the supervision of the construction works with information on their occupational qualifications, experience and educational background necessary to perform the Contract and on the scope of tasks to be completed by them and with information on the basis of their employment during Contract performance;
1.4. a statement saying that the persons who will participate in the performance of the Contract possess required licences; foreign Contractors or persons capable of performing the Contract may confirm qualifications obtained in foreign states in accordance with the rules defined in Article 12a of the Building Act of 7 July 1994 (Journal of Laws Dz.U. of 2006 No. 156, item 1118, as amended), taking into account the provisions of the Recognition of Occupational Qualifications obtained in the Member States of the European Union Act of 18 March 2008 (Journal of Laws Dz.U. No. 63 of 2008, item 394 as amended);
1.5. information from the bank or credit union, confirming that the Contractor possesses required funds or creditworthiness, issued not earlier than 3 months before the deadline for tender submission. If the Contractor relies on financial resources of other entities according to the rules defined in Article 26 paragraph 2b of the Act, information on these entities must be provided;
1.6. a paid policy, or if unavailable, another document confirming that the Contractor is insured and the insurance policy covers public liability resulting from the Contractor's activities related to the object of the Contract. If the Contractor for material reason is unable to submit documents confirming its financial and economic position as required by the Contracting Authority, the Contractor may submit another document sufficiently confirming the fulfilment of the condition defined by the Contracting Authority.
To confirm fact that there are no reasons to exclude the Contractor from the participation pursuant to Article 24 paragraph 1 of the Act, the Contracting Authority requests the Contractors to submit the following documents:
2.1. a statement of the Contractor of no reasons to exclude the Contractor from the procedure;
2.2. A current copy of entry in the relevant register or in the Central Registration and Information on Business, if separate statutory provisions require that the Contractor be entered in the register or Central Information, in order to demonstrate that there are no reasons to exclude the Contractor under Article 24.1.2 of the Act, issued not earlier than within the 6 months preceding the deadline for tender submission.
2.3. a current certificate from the competent revenue office confirming that the Contractor has duly paid all taxes or a certificate confirming that the Contractor has lawfully obtained an exemption, deferment or division into instalments of overdue payments or the decision of the competent authority to impose a tax has been reversed in whole - issued not earlier than 3 months before the deadline for tender submission;
2.4. a current certificate from the competent revenue office confirming that the Contractor has duly paid all taxes or a certificate confirming that the Contractor has lawfully obtained an exemption, deferment or division into instalments of overdue payments or the decision of the competent authority has been reversed in whole - issued not earlier than 3 months before the deadline for tender submission;
3. The Contractor shall submit with the tender a list of member entities of the same group of companies associated by capital links as defined in Article 24 paragraph 2 item 5 of the Act or information that the Contractor does not belong to any group of companies. If the Contractor has registered office or place of residence outside the territory of the Republic of Poland, the Contractor submits instead of the documents referred to in item 2 other documents issued in the Contractor's country of registered office or residence confirming that:
- the Contractor is not subject to liquidation or bankruptcy procedure,
- the Contractor has duly paid all taxes, social and health insurance premiums or has lawfully obtained has lawfully obtained an exemption, deferment or division into instalments of overdue payments or the decision of the competent authority has been reversed in whole.
3.9 Zuschlagskriterien
aufgrund der nachfolgenden Angaben:
 While selecting the most advantageous tender, the Contracting Authority shall apply one criterion, that is the lowest price. The tender containing the lowest gross price shall be selected as the most advantageous one.
The tenders shall be assessed using a scale from 0 to 100 points.
The lowest price from the tenders that are not excluded shall obtain 100 points. The criterion weight is 100%, other tenders shall be assessed according to the formula given in the Terms of Reference.
