3. Bedingungen
3.2 Kautionen / Sicherheiten
1. The Purchaser will require the Contractor to whom the contract is awarded to submit the performance bond, hereinafter referred to as the "bond", for each and every part of the proceedings in the amount of 10% of the tender price.
2 The bond may be provided in one or more of the following forms selected by the Contractor:
1) cash;
2) bank guarantees or guarantees of a savings-load fund, with the stipulation that a fund's obligation is always monetary;
3) bank guarantees;
4) insurance guarantees;
5) guarantees given by entities referred to in Art. 6b., Section 5, point 2 of the Act of 9th November 2000 on the Establishment of the Polish Agency for Enterprise Development.
3. The bond paid in cash shall be paid by a bank transfer to the bank account indicated by the Contracting Authority: 96 1020 3150 0000 3102 0047 7489.
4. The performance bond must be submitted before signing the contract.

3.7 Eignungskriterien
aufgrund der nachstehenden Kriterien:
1.The Contractors, who shall satisfy the conditions specified in Art. 22, Section 1 of the Public Procurement Act of 29th January 2004 (Journal of Laws of 2013, item 907, as amended) are entitled to tender for a contract. These conditions are as following:
1) Holding the licence to carry on business activity or action if legal provisions oblige that it must be held.
Description of the method of evaluating if the condition has been satisfied:
The Contractor shall satisfy this condition if it proves that:
a)it holds the licence to carry on business activity which allows him to produce and manage the waste including the waste containing asbestos and/or to collect waste containing asbestos covering at least the area of a particular part of proceedings the Contractor submits the tender for, referred to in Act on Waste of 14th December (Journal of Laws of 2013, item 21, as amended) - if it is planning to collect waste as defined in Art. 3, Section 1, point 34 of the Act on Waste of 14th December 2012 (Journal of Laws of 2013, item 21, as amended),
b)it holds the licence to carry on business activity which allows it to transport hazardous waste covered by the subject of the contract, referred to in the Act on Waste of 14th December 2012 (Journal of Laws of 2013, item 21, as amended).

2) Knowledge and experience.
Description of the method of evaluating if the condition has been satisfied:
The Contractor shall satisfy this condition, if it proves that over the last three years before the tender closing date or if the period of carrying on business is shorter - during this period, it rendered at least 1 service connected to disassembly, loading, transporting and handing over asbestos-containing products for neutralisation of total value no less than 570 000 PLN gross or no less than 1140 Mg of asbestos-containing construction materials in total.

3) Has at its disposal suitable technical potential and people capable of executing the order.
Description of the method of evaluating if the condition has been satisfied:
The Contractor shall satisfy this condition if it proves that:
- it has at its disposal people, who shall participate in the execution of the order:
a)has at least 18 persons who have been properly trained in the scope of health and safety during the protection and disposal of products containing asbestos pursuant to §3 of the Regulation of the Minister of Economy and Labour of 14th October 2005 on Health and Safety During the Protection and Disposal of Products Containing Asbestos and the Training Programme in the Scope of Safe Use of Such Products (Journal of Laws of 2005, No. 216, item 1824)
b)has at least 6 persons supervising the persons aforementioned in point a), who have been properly trained in the scope of health and safety during the protection and disposal of products containing asbestos pursuant to §3 of the Regulation of the Minister of Economy and Labour of 14th October 2005 on Health and Safety During the Protection and Disposal of Products Containing Asbestos and the Training Programme in the Scope of Safe Use of Such Products (Journal of Laws of 2005, No. 216, item 1824);
-has at its disposal tools and proper technical equipment available to the Contractor.
a)has at least 5 vehicles (including at least 2 with maximum permissible total weight up to 3,5 tons) adapted for loading and transport of waste containing asbestos, that is equipped with a crane which allows loading of waste on the vehicle, and the loading space is free of elements which can cause damage to packages during transport and equipped with clamps for packages, so that the cargo is not exposed to shock, overturning or falling out of vehicle pursuant to §10 of the Regulation of the Minister of Economy, Labour and Social Policy of 2nd April 2004 on Methods and Conditions of Safe Use and Disposal of Products Containing Asbestos (Journal of Laws of 2004, No. 71, item 49, as amended);
b)has a device capable of specifying an approximate weight of asbestos-containing waste located on the premises of real estate, before it is loaded on the mean of transport;
c)has at least 3 devices capable of transporting asbestos products dismantled from roof coverings from the height of 12 m, equipped with a box or loading platform for loading asbestos cement profiled sheets without the necessity to break them down (for example by cutting them).

4) Their current business and financial environment allows the processing of the order.
Description of the method of evaluating if the condition has been satisfied:
The Contractor shall satisfy this condition, if it proves that:
-it holds the civil liability insurance in the amount of no less than 600 000 PLN related to business activity carried on and related to contractual works, and
-holds financial means or credit rating in the amount no less than PLN 600 000

The cash value in foreign currency indicated in the documents submitted by the Contractor in order to prove that it satisfies the aforementioned conditions of participation in the proceedings shall be calculated into PLN according to the average exchange rate of the National Polish Bank as of the date the invitation to this tender is published in the Official Journal of the European Union.

The Contractor can rely on the knowledge and experience, technical potential, persons capable of processing the order or on financial capacities of other subjects, irrespectively of the legal character of relations between them. In these circumstances, the Contractor is obliged to prove to the Contracting Authority, that it shall have at its disposal the resources needed for the processing of the order, specifically including providing it with an original copy of a written undertaking of these subjects to provide the Contractor with the resources needed for the period of executing the order.
2. Contractors are eligible for competing for a contract, unless any reasons for exclusion exist.
3. Pursuant to Art. 24 of the Act, the following Contractors will be excluded from the contract award procedure:
1) Contractors who caused damage by non-performance or improper performance of a contract, or are bound to pay a contractual penalty, if the damage or the obligation to pay a contractual penalty amounts to at least 5% of the value of the contract to be performed and were confirmed by a court decision which became legally valid within a period of 3 years before the contract award procedure was initiated;
1a) Contractors with whom the Contracting Authority has dissolved or terminated a public procurement contract or rescinded a public procurement contract due to circumstances attributable to the Contractor if the dissolution, termination or rescission occurred within a period of 3 years before the contract award procedure was initiated, and the value of the non-performed contract was equal to at least 5% of the contract value;
2) Contractors against whom liquidation has been initiated or whose bankruptcy has been declared, except for Contractors who, after a bankruptcy declaration, entered into an arrangement approved by a legally valid court decision, unless such an arrangement provide for the satisfaction of creditors by means of liquidation of the bankrupt's assets;
3) Contractors who are in arrears with the payment of taxes, fees, or healthcare or social security contributions, unless they are legally exempt from them, the outstanding payments have been deferred or spread into instalments, or if the execution of the competent authority's decision has been fully suspended;
4) natural persons who have been convicted of an offence committed in connection with a contract award procedure, an offence against the rights of people performing gainful work, an offence against the environment, an offence of bribery, a business crime, or any other offence committed for private financial gain, a fiscal crime or an offence of participation in an organised group or in a union aimed at committing an offence or a fiscal crime;
5) general partnerships in which a partner has been convicted of an offence committed in connection with a contract award procedure, an offence against the rights of people performing gainful work, an offence against the environment, an offence of bribery, a business crime or any other offence committed for private financial gain, a fiscal crime or an offence of participation in an organised group or in a union aimed at committing an offence or a fiscal crime;
6) professional partnerships in which a partner or member of the management board has been convicted of an offence committed in connection with a contract award procedure, an offence against the rights of people performing gainful work, an offence against the environment, an offence of bribery, a business crime or any other offence committed for private financial gain, a fiscal crime or an offence of participation in an organised group or in a union aimed at committing an offence or a fiscal crime;
7) limited partnerships and limited joint-stock partnerships in which the general partner has been validly convicted of an offence committed in connection with a contract award procedure, an offence against the rights of people performing gainful work, an offence against the environment, an offence of bribery, a business crime or any other offence committed for private financial gain, a fiscal crime or an offence of participation in an organised group or in a union aimed at committing an offence or a fiscal crime;
8) legal persons where an active member of the managing body has been validly convicted of an offence committed in connection with a contract award procedure, an offence against the rights of people performing gainful work, an offence against the environment, an offence of bribery, a business crime or any other offence committed for private financial gain, a fiscal crime or an offence of participation in an organised group or in a union aimed at committing an offence or a fiscal crime;
9) collective entities which have been prohibited by a court from competing for a public contract under regulations on liability of collective entities for acts prohibited under penalty;
10) Contractors who are natural persons convicted of an offence referred to in Art. 9 or Art. 10 of the Act on Effects of Contracting Work to Foreigners Unlawfully Staying on the Territory of the Republic of Poland of 15th June 2012 (Journal of Laws, item 769) - for 1 year from the date of the judgement becoming final;
11) Contractors who are registered partnerships, professional partnerships, limited partnerships, limited joint-stock partnerships, or legal persons whose partner, member of the management board, general partner or member of the managing body has been convicted of an offence referred to in Art. 9 or Art. 10 of the Act on Effects of Contracting Work to Foreigners Unlawfully Staying on the Territory of the Republic of Poland of 15th June 2012 - for 1 year from the date of the judgement becoming final.

4. Pursuant to Art. 24, Section 2 of the Act, the following Contractors will also be excluded from the contract award procedure:
1) Contractors who directly performed activities related to the preparation of the contract award procedure, except activities performed during the technical dialogue referred to in Art. 31a, Section 1 of the Act, or who, for the purpose of preparing a tender, relied on persons participating in those activities unless the participation of such Contractors in the procedure does not distort fair competition; this provision shall not apply to Contractors who are awarded public contracts under Art. 62, Section 1, item 2 or Art. 67, Section 1, items 1 and 2;
2) Contractors who do not pay the bid bond within the time limit for the placement of tenders, for an extended tender term or within the time limit referred to in Art. 46, Section 3, or who do not agree to extend the tender term;
3) Contractors who provide untrue information, which affects or could affect the outcome of the contract award procedure to be conducted;
4) Contractors who fail to demonstrate that they have fulfilled the procedure participation conditions;
5) Contractors who belong to the same capital group within the meaning of the Act of 16th February 2007 on the Protection of Competition and Consumers (Journal of Laws No. 50, item 331, as amended), submitted separate tenders or applications for participation approval in the same procedure, unless they can demonstrate that their relationships do not distort fair competition among the Contractors in the contract award procedure.

5. For Contractors who jointly compete for a contract:
- Every condition set out in Section V 1 shall be met by at least one of the Contractors or jointly by all Contractors;
- The conditions set out in Section V 2 shall be met by every Contractor on its own.

Evaluation of the compliance with the procedure participation conditions shall be conducted based on declarations and documents submitted by Contractors in accordance with the formula "fulfils - does not fulfil".
3.8 Geforderte Nachweise
aufgrund der nachstehenden Nachweise:
1. In order to demonstrate that the Contractor fulfils the conditions referred to in Art. 22, Section 1 of the Act, for which the Contracting Authority described the manner of fulfilment, the following documents shall be submitted:
1) A declaration to confirm the fulfilment of participation conditions [the original copy] - in accordance with the template in Attachment No. 3 to the Terms of Reference;
2) A decision issued by the Marshal (valid as of the tender submission deadline) approving the management programme for waste to be produced as a result of the services provided, including at least the scope of a given part of the procedure, for which the Contractor submits a tender, or a decision issued by the Marshal/Head of Province (valid as of the tender placement day) permitting waste collection within the business activity conducted, including the collection from the property concerning the scope of a given part of the procedure, for which the Contractor submits a tender [the original copy or a copy certified by the Contractor as true to the original], or a declaration stating that the Contractor does not intend to collect such waste within the meaning of Art. 3, Section 1, item 34 of the Waste Act of 14th December 2012 (Journal of Laws of 2013, item 21, as amended) [ the original copy];
3) A decision issued by the Head of Province (valid as of the tender submission deadline) approving business activity including the transport of hazardous waste included in the subject of the contract, or a confirmation (valid as of the tender deadline) of an entry to the register (kept by the Marshal) of entities involved in waste management [the original copy or a copy certified by the Contractor as true to the original];
4) A list of main services provided in the scope necessary to demonstrate that the condition relating to knowledge and experience was fulfilled within the last 3 years before the tender submission deadline, and if the period of business activity is shorter - within this period, with the values, subject, performance dates specified, for which deliveries or services were provided [the original copy or a copy certified by the Contractor as true to the original] - in accordance with the template in Attachment No. 6 to the Terms of Reference; and attached evidences for the performance or due performance (pursuant to §1, Section 2, items 1 and 3 of the Ordinance of the President of the Council of Ministers of 19th February 2013 on types of documents that may be required from the Contractor by the Contracting Authority and forms in which such documents may be submitted (Journal of Laws of 2013, item 231) [the original copy or a copy certified by the Contractor as true to the original];
5) A list of persons to participate in the performance of the contract, in particular persons responsible for the provision of services, along with the information on their professional qualifications, experience and education necessary to perform the contract, and the scope of their responsibilities, information on the basis of concerning such person to be at the disposal, along with a declaration stating that the persons to participate in the performance of the contract hold the required qualifications [the original copy or a copy certified by the Contractor as true to the original] - in accordance with the template in Attachment No. 7 to the Terms of Reference;
6) A list of tools, factory equipment and technical equipment at the Contractor's disposal for the performance of the contract, along with information on the basis of considering such resources to be at the disposal [the original copy or a copy certified by the Contractor as true to the original] - in accordance with the template in Attachment No. 8 to the Terms of Reference;
7) Information provided by a bank or a cooperative savings-load fund to confirm Contractor's financial resources or creditworthiness, issued not earlier than 3 months before the tender submission deadline [in the form of the original or a copy certified by the Contractor as true to the original];
8) A paid insurance policy, or if there is no such an insurance policy, another document to confirm that the Contractor has taken out civil liability insurance in the scope of business activity associated with the contract subject [the original copy or a copy certified by the Contractor as true to the original];
If the Contractor, in order to demonstrate the fulfilment of the condition referred to in Art. 22, Section 1, item 4 of the Act, relies on resources owned by other entities under Art. 26, Section 2b of the Act, the Contracting Authority will not require the documents referred to in §1, Section 6, item 1 of the Ordinance of the President of the Council of Ministers of 19 February 2013 on types of documents that may be required from the Contractor by the Contracting Authority and forms in which such documents may be submitted.

If, with good reason, the Contractor is unable to present documents regarding its financial and economic situation as required by the Contracting Authority, the Contractor may present another document, which sufficiently confirms the fulfilment of the condition described by the Contracting Authority.

2. In order to demonstrate that there are no reasons for excluding a Contractor from the contract award procedure under circumstances referred to in Art. 24 of the Act, the following documents shall be submitted:
1) a declaration to confirm that there are no reasons for exclusion [the original copy or a copy certified by the Contractor as true to the original] - in accordance with the template in Attachment No. 4 to the Terms of Reference;
2) a valid extract from the applicable register or the Central Register and Information on Business (CEIDG) if separate regulations require an entry in the register to demonstrate that there are no reasons for exclusion, pursuant to Art. 24, item 1 of the Act, issued no earlier than 6 months before the tender submission deadline;
3) a valid certificate issued by a competent head of a revenue office to confirm that Contractor is not in arrears with the payment of taxes, or a certificate to confirm that the Contractor is legally exempt from them, the outstanding payments have been deferred or spread into instalments, or execution of the competent authority's decision has been fully suspended [the original copy or a copy certified by the Contractor as true to the original] - issued not earlier than 3 months before the tender submission deadline;
4) a valid certificate issued by a competent branch of the Social Insurance Institution or the Agricultural Social Insurance Fund to confirm that Contractor is not in arrears with the payment of healthcare or social security contributions, or a confirmation that the Contractor is legally exempt from them, the outstanding payments have been cancelled, deferred or spread into instalments, or execution of the competent authority's decision has been fully suspended [the original copy or a copy certified by the Contractor as true to the original] - issued not earlier than 3 months before the tender placement deadline;
5) valid information provided by the National Criminal Register in the scope specified in Art. 24, items 4-8 of the Act [the original copy or a copy certified by the Contractor as true to the original] - issued not earlier than 6 months before the tender submission deadline;
6) valid information provided by the National Criminal Register in the scope specified in Art. 24, item 9 of the Act [the original copy or a copy certified by the Contractor as true to the original] - issued not earlier than 6 months before the tender submission deadline;
7) valid information provided by the National Criminal Register in the scope specified in Art. 24 items 10 and 11 of the Act [the original copy or a copy certified by the Contractor as true to the original] - issued not earlier than 6 months before the tender submission deadline;
8) if the Contract has its registered office in the territory of the Republic of Poland, the persons referred to in Art. 24, items 5-8, 10, and 11 of the Act, have their place of residence outside the territory of the Republic of Poland, with regard to such persons, the Contractor shall submit a certificate issued by a competent judicial or administrative authority applicable to the place of residence to confirm clean criminal record for such persons, to the extent set out in Art. 24, items 5-8, 10, and 11 of the Act, issued no earlier than 6 months before the tender submission deadline; however, if in the place of residence of such persons such documents are not issued, the documents shall be replaced with a document with a declaration submitted before a competent judicial, administrative, professional or business self-government authority as may apply to the place of residence of such persons, or before a notary public.

3. Documents to be provided by foreign entities.
1) If the Contractor's registered office or place of residence is located outside the territory of the Republic of Poland, instead of documents referred to in:
a) Section VI 2 subsection 2) - 4) and subsection 6) - the Contractor shall submit (a) document(s) issued in the country, in which the registered office or place of residence is located, with a respective confirmation that:
- No liquidation has been initiated or no bankruptcy has been declared with regard to the Contractor, issued no earlier than 6 months before the tender placement deadline;
- The Contractor is not in arrears with the payment of taxes, fees, or healthcare or social security contributions, or is legally exempt from them, the outstanding payments have been deferred or spread into instalments, or execution of the competent authority's decision has been fully suspended, issued no earlier than 3 months before the tender submission deadline;
- The Contractor has not been prohibited from competing for a public contract, issued no earlier than 6 months before the tender placement deadline;
b) Section VI 2 subsection 5) and 7), the Contractor shall submit a certificate issued by a competent judicial or administrative authority applicable to the place of residence or domicile of the person to whom such documents relate, to the extent set out in Art. 24, items 4-8, 10, and 11 of the Act, issued no earlier than 6 months before the tender submission deadline;
2) If in the country of place of residence of the person or in the country, in which the Contractor has its registered office or domicile, the documents referred to in Section VI 3 subsection 1 are not issued, they shall be replaced with a document with a declaration, in which the persons authorised to represent the Contractor are listed as well, submitted before a competent judicial, administrative, professional or business self-government authority as may apply to the country, in which the person has the place of residence, or the country, in which the Contractor has its registered seat or domicile, or before a notary public.
4. Documents of the third subject
If the Contractor, who has proved that it satisfies the conditions mentioned in Chapter V, Section 1 of the Terms of Reference, relies on resources of other subjects with the rules specified in Art. 26, Section 2b of the Act, and these subjects shall participate in the execution of partial contractual works, then the Contracting Authority does not demand from the Contractor the provision of the documents mentioned in Section 2 with respect to these subjects.
5. Documents regarding group of companies
The Contractor, together with the tender, hands a list of entities belonging to the same group of companies, referred to in Art. 24, item 2, point 5 of the Act, or information that the Contractor does not belong to a group of companies (the original copy) - in accordance with the template in the Attachement No. 9 to the Terms of Reference.
